THE CABINET SUBMIT DRAFT LAW TO TIGHTEN SENTENCING FOR CRIMES COMMITED AGAINST MINORS

At its regular meeting held on October 11, 2023, the Cabinet discussed the draft amendment to the Criminal Law and decided to submit it to the State Great Khural. The amendment provides for tougher punishment for crimes committed against minors including increasing the statute of limitations, not allowing pardons and early release from prison (on parole), and increasing the maximum prison term. The draft law reflected that the statute of limitations for crimes committed against minors to be increased from 20 to 30 years, except for life sentence crimes (the statute of limitations period is not considered) and murder of a minor, rape of a minor, sexual exploitation of a minor and human trafficking not to be subject to pardon or to be released on parole and the maximum term of imprisonment to be increased from 20 years to 25 years. The age limit for minors, indicated in the Criminal Code being 14 has been drafted to be 16 years old. The penalty in the form of a fine for disclosure of the secrets of the investigation process for officials and employees is to be abolished, and the prison term for such crime will be increased to 1-5 years whereas it is 6 months to 3 years currently.
